I would like to know who is the idiot that called it global warming?

It’s not that I don’t believe in climate change, it’s that someone named it wrong. I am not a scientist, I am a marketer. Telling everyone they are facing ‘global warming’ as ice is building up outside their house is the exact problem. If it was named ‘climate change’ as compared to ‘global warming’ people might get it better. If it was named ‘weather change’ it would make it even better. Because most people don’t understand ‘global warming’ and for good reason. It’s not warming the entire planet, some areas are experiencing severe drops in temperature.

What’s in a name?

Selling the concept of ‘global warming’ is a much harder sell than calling it a ‘weather change’ or a ‘climate change’ or any other variation.

Telling someone that the reason there are killer snowstorms in some areas of the planet is due to ‘global warming’ is a concept that is hard to swallow for someone that looks out their window and says, it’s warm or cold outside, and that is the extent of their understanding of global warming. I am not saying everyone, I am saying many of the people that bitch and moan about ‘how it’s not real’ in their blogs are the same people that take the simple look at the concept.

The problem with the term ‘global warming’ is that it’s not really ‘warming’ all areas of the globe at the same rate. In fact it’s ‘global cooling’ for many areas as changes will take place over the ocean currents that will force some areas of the planet to face much colder temperatures.

Hence in essence the people that have been promoting ‘global warming’ as a concern have been shooting themselves in the foot each time there is a foot of ice on the ground. It’s hurting their cause.

Recent Examples:

At this stage, phrasing it ‘global warming’ allows for detractors to use simple ’snow storm headlines’ to confuse the issue. Read The Drudge Report sometimes, you will see much of the articles posted recently were about ‘global warming’ conferences being canceled due to snow storms. He wouldn’t of been able to post those articles in a negative light if they were called ‘climate change’ conferences.

Examples:
Recent Headline on Drudge regarding ‘global warming’:

It doesn’t make such a great headline anymore using ‘Climate Change’:
Climate Change Conference canceled due to Snow Storm

Both examples say the same thing, it’s just that one makes the Global Warming attendees look like idiots, while another looks like the problem is more urgent than even realized.

I don’t care what the scientists call it, the average public that the scientist has to convince is reading the first Drudge Report headline, not the second.

so i arrive at my local blockbuster video store, which happens to be in a local mall. i park in the fire lane, as i’m just running in to return a few videos and pick up a few more with my blockbuster total access membership (which totally rocks, btw), knowing i wouldn’t be in the store for longer than 10 minutes at most.

i come back outside a few minutes later to see this garbage on my windshield, and the POS security homosexual that wrote it power-walking (practically sprinting) down the mall, writing out “violations” to each car parked in the fire lane (and there had to be at least 20 of them).

was i wrong to park in the fire lane? probably. do i care? no. what really amuses me about this “violation” is the wording on it…

“This vehicle’s description has been permanently recorded. Any additional infractions of our regulations could result in towing at vehicle owner’s expense and revocation of parking privileges.”

wtf? i have several problems with this - allow me to elaborate…

first, if you’re going to get a tow truck, hook it up to my car, and tow my car - and do all of this within the 10 minutes i’m in the store - more power to you. i’d love to see you accomplish it, although i’m not sure how considering you’d still need to finish your sprint to make sure all of the vehicle owners parked in the fire lane are properly notified of their “violations.”

second, how exactly do you plan to tow my car when it’s parallel parked between two other cars that are also parked in the fire lane? are you going to drag it horizontally?

third, are we in high school? revocation of parking privileges? are you f***ing kidding me? i feel like i’m back in elementary school and was just given a demerit. three demerits gets you detention. “now timmy, don’t park like that again. if you park like that two more times, you’ll be sent to detention and lose your parking privileges. be smart about this, mmmmmkay?” give me a f***ing break.

fourth, how exactly do you plan to enforce this “revocation of parking privileges?” ok, so it’d be obvious if i was parked in the fire lane again that you could see my car and get upset (i won’t say you’d give me a ticket, because if you gave tickets that cost people actual money, you would have done it in this case). let’s say i, being the smart individual that i am, park in an actual parking spot so that my car blends with the others - are you going to walk around the entire lot, looking for cars that have had their “parking privileges” revoked, so that you can write them another “violation?” if the cressona mall is actually paying its security guards to do this, maybe that’s the reason the mall sucks ass to begin with, and has been largely abandoned for years.

on a happy note, this has given me an idea for a new website. details will follow shortly. as for you, mr. parking nazi idiot that wrote me this “violation,” just be happy i didn’t get out of the store in time to take your picture - that would’ve been a bad day for both you AND the mall.

Assume that U.S. is heavily dependent on trade with Gotham. On January 1, 2005 the exchange rate was $1 for 8 Gotham rubles.
2a. Describe the concept of depreciation and invent an example of depreciation of the U.S. dollar against the Gotham ruble in 2005. The concept of depreciation of the U.S. dollar is “when the dollar trades for fewer units of the foreign currency.”(1) In other words, one dollar is worth 8 rubles on January 1. The dollar depreciates and on March 1, the exchange rate is now one dollar for 4 rubles. An example of this would be high interest rates in Gotham. Americans start buying Gotham securities for the higher interest rate. To buy these securities, Americans first have to trade more dollars for rubles. The result would be the decline in the exchange rate of the dollar/ ruble.
2b. Describe a sequence of events that would lead to depreciation of the dollar (against the Gotham ruble) by shifting the supply of dollars curve. Gotham has just invented the widget. A widget allows American students to write papers just by thinking about them. The widget is the hottest item on the market today. So, Americans go and start ordering widgets by the thousands. The demands for these widgets cause Americans to first exchange their currency in rubles, and then purchase the widget. The supply curve would be shifted to the right in the ruble/$ graph causing the exchange rate to be lower and the dollar would depreciate to the ruble.
2c. Describe a sequence of events that would lead to depreciation of the dollar (against the Gotham ruble) by shifting the demand for dollars curve. Americans enact a bill that the minimum wage will now be fifty dollars an hour. Because of this wage floor, all goods made in the U.S. now cost four hundred percent more. The huge hike in cost has made people in Gotham not want to buy American goods. So, Gotham citizens do not need to exchange their rubles to buy American goods because the goods cost too much. The demand for dollars decreases and pushes the demand curve to the left of the ruble/dollar graph. This in turn causes the exchange rate to become lower and causes the depreciation of the dollar to happen.
2d. Discuss the positive effects of depreciation of the dollar on the health of the U.S. economy. Some of the positive effects of depreciation of the dollar are that exporters of U.S. goods and services can be more competitive in foreign markets. The U.S. goods that are sold do not cost as much to foreigners now. Another positive result is that the trade deficit will be better because more exports should now be sold and Americans will not buy more expensive imports. Every American will also buy American goods because they are cheaper than anything brought in from Gotham. Also, jobs would come back to America because it would cost less to pay workers here than in foreign lands.
2e. Discuss the negative effects of depreciation of the dollar on the health of the U.S. economy. One of the negative effects of the depreciation of the dollar is that financial assets in America are now cheaper to foreigners. In other words, land and buildings has become cheaper for foreigners to buy. Heavy foreign investment would happen in America, which would not be a good thing. Also, importers of foreign merchandise and goods would now have to pay more causing these parts of the economy to suffer from the depreciation of the dollar. The last negative thing is that financial investments in foreign lands would be more expensive to Americans and would result in less ownership of assets worldwide.
2f. In your opinion is depreciation good for the health of the U.S. economy. I believe depreciation is neither good nor bad in our economy. Too much one way or the other is bad for our economy. If you have a huge depreciation of the dollar, exporters and the trade deficit would be better, but imports would be crushed. Also, the foreign ownership of America would rise to the point that we would own nothing in our country. At the same time, a huge amount appreciation of the dollar would lead to less foreign ownership, but a huge trade deficit. Also, jobs would get outsourced because of expensive labor in America. My stand is that countries should just open up their markets and let the supply and demand of currency take its own course. The U.S. economy would be better with depreciation of the dollar, but I think we would be sacrificing short-term gains against long-term losses.

D.Q #1. Who were the key stakeholders involved in, or affected by, the negotiations for a tobacco deal, and what were their central interests? To what degree were the interests of the various stakeholders met by the 1997 settlement? By the 1998 settlement?
Many different stakeholders are involved in this case. The first stakeholder includes smokers of tobacco. Smokers’ primary interests in this case are for tobacco prices to remain affordable. Smokers want the right to smoke and also the right to afford tobacco on a regular basis. The 1997 and 1998 settlements resulted in a price hike. Smokers complain about the increase, but are thankful that the costs are still manageable.
The second group involved is the employees of the tobacco firms. The central interest is that the employees want to keep their employment. The 1997 settlement would have capped liabilities for the companies. This would provide a more solid ground financial for the firms and in turn, provided a better outlook for the employees to keep their jobs. The 1998 settlement has no such cap and could actually cause the firms to go into bankruptcy. Employees of tobacco companies were much better served with the 1997 settlement than the 1998 settlement.
The third stakeholder is the tobacco industry. The tobacco firms are trying to stay in a very profitable market that causes harm to its users. The product liability of the tobacco firms is one of two key interests in this case. The other key interest is to keep government from regulating tobacco products. The 1997 settlement produced a very positive result in terms of product liability. All cases would be settled through this agreement. The firms liked this because they were spending over 600 million dollars a year on legal fees alone. The bad part was that the government wanted to regulate and control their product. This ultimately caused the collapse of the 1997 settlement. The 1998 settlement allowed the firms to keep the government from controlling tobacco products, but future product liability was not agreed upon. Future users of tobacco can still sue these companies for product liability.
The fourth group involved is the government in two parts, the Food and Drug Administration (FDA) and political parties. The FDA has tested tobacco and has claimed that it (Nicotine) is an addictive drug. This fact allows the FDA the right to regulate tobacco products. The 1997 settlement put the FDA in charge of the amount of nicotine that could be in a tobacco product. The 1997 settlement fell apart because the tobacco companies did not want to be regulated by the FDA. The 1998 settlement did not satisfy the interests of the FDA because the tobacco companies kept the FDA out of the agreement. The political parties on the other hand had different interests in this case. The amount of money in taxes (13.1 billion in 1996) and contributions to political funds (6.6 million) made this case a huge conflict of interest for Congress. The 1997 settlement seemed to make everyone happy from the voting public to the FDA. The problem occurred when the tobacco companies themselves pulled out of the deal. Desperate to get a deal done, Congress half-heartedly supported the 1998 settlement. Later, Congress said that the FDA should be in charge of regulating the industry, but has not followed up on this idea.
The next group that has a key interest in this case is the media, which has had a field day with this topic for years. Investigative reporting has dug deep into the tobacco case to help push smoking into the national limelight and help sell newspapers. The 1997 settlement was published in almost every newspaper in America. The media is probably thankful that the 1997 settlement failed. The 1998 settlement could still make the tobacco industry liable. The media will keep reporting on this case until a true final settlement is reached.
The sixth stakeholder involved is the advertising agency. The advertising of tobacco is big business for magazines and billboards. The loss of this money from tobacco firms would mean that the advertising agency would have to generate a portion of the advertising income from another industry. The 1997 settlement banned all advertising everywhere. This settlement was a huge blow to the advertising business. The 1998 settlement allowed for advertising and is much more appealing to the advertising agency.
The seventh stakeholder is the health care industry. Smoking has taken its toll on health care in this country. Tobacco’s impact on health care is staggering with about 500,000 people dying each year from either smoking or tobacco-related illnesses. The health care industry would like to abolish smoking altogether. The 1997 settlement, while very substantial, allowed the states to use the money as the states saw fit. So, even with all this money, the states could actually use the money on other projects instead of the health of the public. The 1998 settlement has done the same thing. States have used the money on roads and other public utilities instead of health care. The deal was a bad one for the health care industry.
The last key group is the pubic health community including children’s health advocates. The tobacco companies try to recruit children to smoke because the firms have to keep replacing customers whom have died. The public health sector has tried to make it illegal for companies to target children. The 1997 settlement would not only suspend tobacco companies from selling to minors, but also fine the companies if youth smoking did not drop to a determined target in the upcoming years. The 1998 settlement was a blow for this stakeholder group because tobacco companies took this provision out of the deal.
D.Q.#2. Should the FDA regulate tobacco? What are the key arguments for and against involvement of the FDA in restricting or banning the sale or promotion of tobacco products?
I believe that the FDA should have some guidelines for tobacco. The key argument for involvement is that tobacco is known to kill. The number one killer of Americans should have some sort of regulation. Just like alcohol in beer, nicotine and other chemicals should have a set amount in every tobacco item. Another argument is that these companies target children and teenagers. The FDA should be allowed to ban minors from smoking. The argument against involvement is that smoking is not as addictive as other drugs. Freedom of speech and advertising starts to creep into the argument as soon as you take a company’s ability to market away from a certain part of the population. Knowing all these, I still believe some form of regulation needs to happen to keep the tobacco companies from profiting on the youth.
D.Q.#3. What mechanisms of political influence had the tobacco industry historically used? Do you believe that the tobacco industry influenced the public policy process legitimately, or did it have too much influence?
The mechanisms that the tobacco companies used were lobbying firms, political contributions, and public relations efforts. The lobbying firms used their power to promote free speech and the rights of people to choose. The tobacco industry also contributed large amounts of money to candidates in support of their causes. Lastly, every time the industry had an apparent setback, the industry turned the setback into a public relations gem. For instance, when Congress raised taxes on tobacco, the industry raised the prices of their products and blamed government interference for the price hike. The tobacco companies did everything in their power to help further the industry. The process was not overly influenced by the tobacco industry because the courts have slowly weakened the position of the tobacco industry. Also, there is no evidence that is presented in this case that the tobacco industry violated any campaign finance laws or other rules governing political advocacy by business.
D.Q.#4. Do you think it was ethical for the tobacco industry to continue to market cigarettes, even after evidence emerged that smoking caused lung cancer and other illnesses? In your answer, please refer to the three main methods of ethical analysis: utilitarianism, rights, and justice.
The tobacco industry was ethical to continue to make cigarettes. The fact that lung cancer can develop in smokers is a terrible by product of smoking. Alcohol causes liver problems, but the alcohol industry continues to make its products. From the utilitarian perspective, the benefits have exceeded the costs. The tobacco industry has remained profitable for a very long time with a product that can cause death to its users. The human costs are very hard to show other than through lawsuits. The rights of smokers to smoke have always been an issue. As long as people want to smoke, the tobacco industry has the right to make the product for them. Many smokers are very happy when they are smoking, so is that pleasure balanced with the pain associated with lung cancer. Justice is the only ethical analysis that contradicts this position. Public justice for being lied to on the health issues of smoking places the tobacco industry on shaky ethical ground. Tobacco companies would have been better off to just tell the truth early on and settle this debate four decades ago.
D.Q.#5. Do you think new tobacco legislation is needed? If so, what would be the key elements of such legislation?
The only new legislation needed for the tobacco industry is to monitor the levels of chemicals in the product. The FDA would be the best government organization to make sure the chemical amounts in tobacco were uniform. Everyone already knows it can be bad for your health, so the legislation should be to keep the tobacco industry from adding more addictive chemicals to the cigarettes. Other than that, the amount of legislation on tobacco is sufficient as long as the laws are being followed.

ok, so the reason for my visit to detroit has absolutely nothing to do with global warming, awareness, or globalwarming awareness2007 - i really don’t care. i wanted to post a blog to let everyone know that i shall be heading to the wonderful wrestling spectacle called wrestlemania.

ok, so i’m nuts. i’m going to spend 8 hours in a car and drive 500 miles to watch a wrestling event…yes, i know it may seem stupid to other people. my response to that is simple: i don’t care what you think. i’ve been watching wrestling since i was a little kid, and i want to see wrestlemania in person.

this is the 23rd wrestlemania - how many people can say they’ve actually gotten to see a wrestlemania live and in person? not many. could i have waited until wrestlemania was somewhere closer to home, like new york or philadelphia? sure i could have - and i wouldn’t have gotten tickets. this thing sells out routinely in less than 2 minutes. i am fully convinced that the only reason i got tickets this year is because the event is being held at ford field, which seats more than 70,000 people.

the moral of the story is: yes, i’m nuts - oh well. i don’t care. if you’re not down with wrestlemania, i’ve just got two words for ya…well, nevermind. :-)

1. Investing
You are financial advisor specializing in speculative real estate project in Florida and U.S. government bonds.
1a. Develop rate of return versus risk analysis of these two types of investments. As a financial advisor, the rate of return is completed different for these two types of investments. The speculative real estate project in Florida is a very high risk, possible high rate of return investment. The government bonds are a very low risk, lower rate of return. The high risk in the investment of real estate is that you are relying on the fact that people will pay more for the land/property than what you bought it originally. The risk is that the warm weather and no income tax in Florida will attract older people to buy your investment. The possibility is there for you to make a greater return on your money. The high risk is that the real estate market could go south on you. You have money tied up in land no body wants. Lets say a hurricane wipes the area out and there is nothing left to attract anyone. That is why this is a high risk, possible high reward situation. The government bonds have a return that is guaranteed because they are backed by the U.S. government. The only way for you to lose money on this investment is for the U.S. government to default on the bonds. Of course, the amount of return has been pretty consistent for the last couple of decades, which is a very modest return on the investment.
1b. Develop rate of return versus liquidity analysis of these two types of investments. The rate of return versus liquidity is also different for both of these investments. The real estate investment has a possible high return versus low liquidity. The high return is due to the facts I have mentioned above. Actually, my uncle bought property in Florida. He owns four time-shares somewhere in Daytona. He has been counting on the income generated by the tourist to finance the properties. The rate of return is high, but selling these properties has a low liquidity. If he wanted to sell these properties, he has to first find someone to buy them. Then he has to agree to a price. After that, he has to have settlement on the property. This process takes time. Even in the best circumstances, you are lucky to get what you want for the property and settle in two months. The investment of government bonds has a lower rate of return with a very high liquidity. The government bonds have their own trading in the secondary markets, so selling the bonds for cash is very easy. You could turn bonds into money in about a day. Of course, once again, the bonds do have a lower rate of return.
1c. Describe the type of investor for whom you would recommend the Florida real estate. The type of investor I would recommend to invest in the real estate is someone whom is looking for a long-term investment plan. I would actually tell someone who has money that they are doing nothing with and do not need it for anything in the next ten years to invest in the real estate. Lets say you are thirty years old and have one hundred thousand dollars lying around. This would be a sweet deal for that kind of person. The high risk and low liquidity is worth the possibility of higher return over the long-term. My uncle, who is sixty-three, is not the type of person I would recommend for this investment. He retired already and might be in serious trouble if a hurricane wipes out his investment. The problem is you really cannot tell my relatives that they are crazy. They seem to go against all good advice.
1d. Describe the type of investor for whom you would recommend the government bonds. I would recommend the government bonds as an investment option to most people. This investment is a solid option that would appeal to most investors. In most portfolios, government bonds are almost always a percentage of those portfolios. I would recommend government bonds to older people and people that had the need for an investment with high liquidity. My parents’ portfolio has about thirty percent of government bonds in it. They are almost sixty years old and this is a very solid base to have in your portfolio. If the stocks or mutual funds fail, the government bonds will keep them from being bankrupt in their retirement account. My uncle should be doing this. Even a person like myself, at thirty-one, has ten percent of government bonds in my portfolio. Government bonds are like the foundations of investing in the U.S. The bonds allow you to have a solid investing foundation to build the rest of what you invest on. Dr. Sinisi, I think you would be a great candidate for government bonds. I would highly recommend at least part of your portfolio be government bonds.
2. Electronic funds transfer system
2a. Define and describe examples of the electronic funds transfer system (EFTS). There are many different examples of electronic funds transfer system. The first examples are credit and debit cards. Credit cards are actually loans from the company that owns the card. When you use a credit card, you electronically add more to your loan. As a consumer, you are responsible for the debt accumulated on the loan. As my friend likes to say about his credit card when we go out to eat, “just swipe it.” Debit cards are used just like credit cards except the money comes directly from your checking account. If you do not have enough funds for your purchase, you will not be allowed to buy whatever you are trying to buy. I have seen this many times at stores. The stores know right away if you can afford it. Another example of an electronic funds transfer system is direct deposit. Employers can now deposit your paycheck directly into your account from their account. You usually get a little stub from the employer that the money has been deposited into your account. The last example of an electronic funds transfer system is the ATM machine. You use your debit or credit card to get money out of your account. The transfer of money comes out of your account and delivers money right to you. I have seen newer versions of ATM machines that allow consumers to do all their banking needs including transferring money from checking to savings accounts, deposits, and paying bills automatically.
2b. Describe your own uses of EFTS. I use EFTS for everything except paying my rent. I have the Army and Penn State University as my employers and both of them direct deposit into my checking account. I pay my phone bill and cable bill with my credit card on-line. I pay my credit card with my checking account on-line. I use my credit card to pay for groceries and gas. I put money on my PSU ID card so I can buy lunch at school. I paid my PSU bill on-line. I got a parking ticket and you can go to a website and pay on-line. I use EZ pass to pay for my tolls on the road. I have three different companies that I have mutual funds (and bonds) invested. I can electronically move money around into different accounts in each company to try and get a better return on my investment. The only time it seems I have to use cash anymore are the restaurants around Schuylkill Haven. No one takes EFTS in this town. I seem to have embraced technology to the fullest.
2c. Describe what in your opinion the most important advantage of EFTS is. The singular most important thing of EFTS to me is the convenience. I can take care of all my bills in about three minutes. If I trusted auto-pay with my bank, I would not have to spend any time on my bills. I also like to see where the money is really going and what my bills are for the month. If my phone bill is high, I want to make sure I am getting charged correctly. The same thing occurs with my credit card bill. The convenience of not carrying around large amounts of cash is refreshing. The security of no losing this large amount of money if robbed is also refreshing.
2d. Describe what in your opinion is the most serious problem associated with EFTS. I think the most serious problem is theft of banking numbers and credit card numbers from Internet transactions. “A hacker who gained access to millions of credit card numbers apparently did by breaking into a computer system at a company that handles transactions for catalog companies and other direct marketers.”(1) In 2003, a hacker stole about 40 million credit card numbers. The stealing of these numbers makes me very concerned when I do transactions over the computer. My parents refuse to pay anything on-line. The concern is very founded and real. This example is not the only example of credit card numbers being stolen over the Internet. My fears will always be there because humans will try to steal these numbers anyway they can. Thieves know that it is just a matter of time before they figure out a way to get someone’s credit card number. This is the biggest concern using EFTS facing us today.
2e. Speculate on why banks and business firms have adopted EFTS. I would have to believe that banks and business firms have adopted EFTS because of consumer demands. Bank consumers want the convenience of auto-pay, on-line banking, and any other EFTS a bank can offer. Consumers definitely drive the market for banks to move to complete EFTS in the future. Business firms have moved to EFTS because most employees like direct deposit. Happy workers are more productive and if moving to EFTS makes them happy, business will do it. Also, it has to be more convenient for business to just use EFTS then writing paychecks to their employees. Money is being saved, more convenient, and makes the employees happier. This is the biggest no-brainer in business today.

My first interest in my topic came when I was listening to Toby Keith singing his song Whiskey Girl. I kind of liked the song and I happened to be listening to it on the way home from class. We had just listened to one of your tales involving whiskey, so I thought that a good topic would be the Whiskey Rebellion. I also knew that the Whiskey Rebellion had to do with the mobilization of the armed services. Since I am a member of the U.S. Army Reserve, I thought reading about how the armed forces used to function would help me better understand today’s army. Sadly, I see that the armed forces are just about the same disorganized mess today as they were back then.
The sources that I found for my topic were not that difficult to find. The problem was trying to only cipher out the information that I needed. I was just trying to look at the Whiskey Rebellion through a soldier’s eyes and the causes leading up to the rebellion. The library at campus had only two books related to my topic. The first book was by Thomas P. Slaughter. I had checked this book out almost six weeks ago before you mentioned it to me on my last assignment. Mr. Slaughter’s book was very good, but a little difficult to follow. I had to read a good portion of the book to find the information I was seeking. The other book the library had was by Leland D. Baldwin. This was more of a book about the rebels’ cause and the events following them. Still, it gave some insight on how the government was hated by just about everyone. The last source that I pulled information from was the Internet site written by Tom Hart. I choose this site for the clarity of the events with the dates. I needed dates to coincide with my letters and the books made it hard to figure this out. The Internet site allowed me to scroll quickly through the text to find out the chronological order of events for this time period. Of the three sources, Mr. Slaughter’s book was the most helpful. The Internet was definitely second and then Mr. Baldwin’s book. I wish I could have found some books or sites related to just the military’s involvement, but I never found any.

gary walters, the ncaa tournament committee chairman, has proven himself to be a quite obvious moron. if you asked him, he might blame globalwarming awareness2007…but who knows?

he, in his infinite wisdom, thought that it would be a good idea to put stanford in the tournament over two obviously more deserving teams - syracuse and drexel. stanford then proceeded to get slammed by 20 points to #6 seed louisville. the cardinal were so awful that they trailed 41-13 at one point, and by 26 points at halftime.

thanks gary, for putting a 18-12 team in the ncaa tournament. i sure am glad you could see that stanford was one of the 64 best teams in the country, and clearly better than syracuse and drexel. thanks very much, you no-talent ass clown.

1. Introduction
Ever since the passing of the 2002 Sarbanes-Oxley Act by Congress, corporate America has been seen by the public as turning over a new leaf. Corporate America is now seen as an entity that has been sufficiently punished and reeled in by the new law. The Sarbanes-Oxley Act was suppose to punish “white-collar” crime more severely, improve accounting to the general public, and raise new issues about conflicts of interest within the board of directors. The thesis I want to explore is to determine if this law has really done what it was intended to do. While the accounting crime is given a stiffer penalty, how has this law done in getting the conflicts of interest out of the boardroom? How do you determine if there is a conflict of interest? Where is the line of doing what is best for the company and helping yourself out through the company? My research for this project has been the board of directors of pharmaceutical companies. The pharmaceutical company had to be in the Fortune 1000 this past year to be considered.

2. Interrupting the numbers
The first part of this research was to find pharmaceutical companies in the top 1000 of companies in the United States. The searches lead me to the first unique experience working on this project. The dynamic of change does not stop within very successful businesses. After finding nineteen companies on the Fortune 1000, I noticed that two of these companies had already merged into one. Hospira had merged with Abbot Laboratories under the name of Hospira. I thought nothing of this merger since businesses in America try to position themselves for the best future possible. Then, I thought into what happens to board members when companies merge. Is the best interest served in figuring out which members are staying and which ones are leaving? Or are there conflicts of interest among board members on which members to keep? Surprisingly, I got my answer from another huge merger several years within the pharmaceutical industry. Upjohn Pharmaceutical merged with Pfizer a couple of years back. Almost the entire Upjohn board was released when this merger happened. Was this the right thing to do for Pfizer? My research found that five of those Upjohn board members are now on the Schering-Plough board of directors. The conflict of interest seems to be high in that the new Schering-Plough board of directors as a group moved to the same new company. My conclusion for this is that many members felt slighted in the take over and want to continue in the same industry against their former company. As for Hospira and Abbot, I would imagine only time would tell to see if departed board members join the same firm in the same industry.
The second and most fascinating part of my research had to deal with the board of directors’ ties to banks and bank boards of directors. With the Sarbanes-Oxley law, companies would be under greater scrutiny for conflict of interest. How do you determine if the conflict of interest happened? Well, the numbers cannot do this for us. However, we can determine through the numbers if the chance does exist. Of the 195 board members, 19 of them were currently of previously employed by a bank, financial institution, or some of form of investment monies for businesses and 12 members have been part of another pharmaceutical board (Chart 1). 9.75 percent of pharmaceutical boards have ties to the investing community. The average size board of directors in a pharmaceutical company is around 11 people. This translates to an average of one person per board has a chance to have a conflict of interest when dealing with financial institutions.
But, let’s take a closer look at the companies from the top nine pharmaceutical companies versus the bottom nine. The difference in power and influence comes from the great disparity in money generated by the top nine. The fall off is dramatic when separating the companies this way. The average position for the top nine in the Fortune 1000 is around 100 while the average position for the bottom nine is around 750. With this huge difference, I have been able to see a different pattern of between these two groups. The first is that eight of the nine have a least one banker on their board. (Only Schering-Plough has 0, but I would think that the rejected members of Upjohn are trying to prove that they can do this on their own) Of these nine, three of them have more than one banker on their board. While the bottom nine has only six out of nine with a banker. Of these, only one company has more than one banker. By the numbers, this means that the top nine boards of directors have 98 members with 12 of them directly related to the financial world. The bottom nine has 97 members with only 7 of them directly related to the financial world. (Chart 3) Broken down, that means the top nine has 12.25 percent versus 7.21 percent for the bottom nine. These numbers are significant in that the greater the amount of money the company is worth and generates, the greater the chance that some financial institution has placed one of its own on the board of the pharmaceutical company.

3. Summary
Pharmaceutical companies have the appearance of following the Sarbanes-Oxley Act of 2002. Board members are now from independent sources outside of the company. However, appearances are very deceiving. My data and research has shown large amounts of possible tainted advice coming from the financial world through getting members on the board of directors. Also, the larger the pharmaceutical business, the greater the chance that the financial community has placed a member on the board. In other words, banks want to try and get a slice of the pharmaceutical money pie by having insider information from one of the board members. (Chart 2) The last figure shows the slice of individuals in the pharmaceutical board of directors that potential are polluted with self-interest and conflicts. In my opinion, the Sarbanes-Oxley Act has done nothing more than to put window dressing on a very real and ugly problem of conflicts of interest in business in America. Large corporations will bend the law to get an ever increasing market share while smaller businesses deal with the undue pressure and financial burden of this unfair law.

The first artist that I choose for my paper is Joe Lovano. After searching the Internet, a person can find a huge amount of material on Joe Lovano. There are 10446 sites related to Joe Lovano.The official home page for Joe is www.joelovano.com/video.php. Joe Lovano was born in Cleveland, Ohio on December 29, 1952. Joe first started to play alto sax when he was little, but later switched to tenor sax by his father Tony (aka Big T.). Later in life, Joe will play just about every instrument including soprano sax, bass clarinet and drums. Joe’s uncles and father played jazz at nightclubs and made sure that Joe was around jazz all the time. Some of the artist that Joe has played covers for include Duke Ellington, Ornette Coleman and John Coltrane. I have listened to a couple of pieces that I will discuss shortly, but it seems that the free jazz style and playing by Ornette Coleman and the musical blend of Duke Ellington are his two biggest influences. Joe Lovano has played with many artists in his life span. He was part of the Mel Lewis Orchestra for a while, but Joe has played with Elvin Jones, Carla Bley, Lee Konitz, Charlie Haden and Bob Brookmeyer, among others, eventually joining the modern drummer Paul Motion’s band in 1981. Joe has had numerous gigs and jobs over the years, but I will only talk about two of them. Topsy Turvy off his Rush Hour album and Duke Ellington’s Sound of Love off his Quartet at the Villa Vanguard. His second piece was with the artists Mulgrew Miller, Christian McBride and Lewis Nash. The majority of the music produced by Joe Lovano has been under the Blue Note Label. The thing that caught my attention about Joe is the way his whole life has been jazz. From a very early age, Joe has been completed surrounded by jazz. Since I am a clarinet player, I am partial to anyone that plays the clarinet. The other thing that was interesting about Joe is that he really hasn’t played with anyone that we talked about. I wanted to find out just what kind of music he made. The first piece that I listened to was Topsy Turvy. The album is Rush Hour. This album was talked about in every Internet site about Joe. I choose this piece because it was a Joe original, not a song taken from another artist. The beginning of the song has a person kind of scat singing like Louis Armstrong. After about a minute, the voice and the tenor sax are the only sounds left. The voice is more of a color or timbre at this point in the piece. Joe’s playing is very technical and crisp. He has a very clear sound almost like Lester Young. Joe plays with very little vibrato the whole way through the piece. The style of the song is more free jazz than anything else. I could hear the influence of a Cecil Taylor or Ornette Coleman all over Joe’s playing. The second piece I choose was Duke Ellington’s Sound of Love. This musical piece was produced in 1995. The members of the quartet were Mulgrew Miller, piano, Christian McBride, Bass, and Lewis Nash drums. The influence of Duke Ellington is seen throughout this piece. Joe Lovano sounds more like Coleman Hawkins with lots of fullness and vibrato. The piece was more of a slow swing piece that a person would dance along with a partner. I have to say that the technical playing exhibited in this piece is really amazing. The scales used by Joe make you think this piece is also modal.
The second artist that I choose for my paper is John Scofield. After searching the Internet, you can have about 62491 sites related to John Scofield. The homepage I found for John was www.johnscofield.com. John was born in Dayton, Ohio in 1951. John plays the guitar. He plays both the acoustic guitar and the electric guitar. The artists that have influenced John Scofield include Miles Davis, Thelonius Monk, and Herbie Hancock. John’s playing is so unique that he reminds me of the Charlie Christian of his time. Some of the artists that John has played with include Miles Davis, Joe Lovano, Chet Baker, Gerry Mulligan, Steve Swallow and Bill Stewart. The label that John plays for is Verve Records. He started playing for Verve Records in 1996 with his Album Quiet. One thing that interested me about John is that he is a guitar player. I felt that I wanted to learn more about someone who plays an instrument that seems to be played by many in our society, but mastered by so few. Another thing that sparked
